Rules Available
The approved new rules and regulations to Section 305.15
Sale of Foods and Beverages in Participating Schools took
effect October 17, 2006.
The rules and regulations establish requirements for
the types of beverages and food that public and nonpublic
schools participating in the federal School Breakfast
Program and/or the National School Lunch Program
may sell to students in grades 8 and below before school
and during the school day. Schools not participating
in the federal nutrition programs are not subject to the
standards. This includes those nonpublic schools that only
participate in the Special Milk Program
The amendments also provide a process for participating
schools to seek an exemption from the nutrition standards
for the 2006-07 school years (only). This exemption
process acknowledges that many participating schools may
have food and/or beverage contracts in place that would
prevent them from fully meeting the standards or have insufficient
time to establish procedures necessary to ensure that students
in grades 8 and below do not have access to food or beverage
purchases not meeting the standards.
